'Yellow'
journalism taints keen legal mind 22feb03 ADRIFT
on the Gold Coast this week, we are not completely aware of how South Australians
have reacted to the ambush of the Director of Public Prosecutions, Paul
Rofe, by TV program Today Tonight. Having
seen it here on Wednesday evening however, we would fervently hope that
most people have been infinitely more appalled by the modus operandi of
the program than any of the behaviour it portrayed. "Yellow journalism"
was one phrase which came instantly to mind. So, too, did we consider "scurrilous
and deceptive" to be the most apt description of the subsequent interviewing
technique. To us – and, we understand, to many others – the entire episode,
while cloaked in a veneer of public interest, smacked of an attempt by
some entity, abetted by the program, to smear a prosecutor who had procured
a guilty verdict in a particular murder case. Indeed, as the Henry Keough
matter was given currency in the course of the interview – and as pro-Keough
activists continue to pursue every avenue they can to overturn the considered
verdicts of a jury and judges – it might well be thought that this was
the crux of the set-up. If so,
the instigators can feel pleased. Paul Rofe, a decent, brilliant, hard-working
and occasionally guileless and flawed human being, was surely made to look
foolish and vulnerable. Knowing him as we socially, occasionally, do –
though not having spoken to him in the interim – we believe Mr Rofe and
those around him will have keenly felt the personal pain such snide techniques
inevitably arouse. But they
will be as nothing to the emotion and dismay invoked by the unsubstantiated
inference that his $10 each-way bets might have in some way affected the
carriage and administration of justice in SA. As, we hope, the legal fraternity
will have already substantiated en masse, Mr Rofe has long recruited and
given great responsibility to some of the keenest, most dedicated legal
minds available. And just
as Mr Rofe has spent countless evenings and weekends reviewing and recommending
process since a serious stroke limited his once formidable courtroom capacity,
so has his team performed unstintingly to ensure justice is done in every
single instance in SA. If there
is any consolation for Mr Rofe and his magnificent team, it might be realising
that public figures everywhere are now receiving the same sort of treatment
from the media and elsewhere. PEOPLE
here were saddened this week to learn that the 25-year marriage of Queensland
Government Tourism Minister and Member for Currumbin, Merri Rose, had ended
under the strain of unprecedented attacks from what she has described as
"a disgruntled network of cronies in the racing industry". "They have
tried every dirty trick in the book, to the circulation of patently inaccurate
information, forgery and highly defamatory material about me," she told
Parliament. "But I have a message for the cowards who hide behind respectability.
I will not be diverted or stopped from making the reforms the Queensland
racing industry so desperately needs." 'Nuff said. -----

Rofe
is corrupt. Corporate Affairs Corporation Investigator, Barbara Thorpe,
interviewed me and then rewrote some pages of her record before having
it typed. Then in a criminal trial of me she told Magistrate Kelly
she had not edited her handwritten notes.
The
Police investigated and with forensic evidence put the case to Rofe for
prosecution. Rofe refused so I went to jail for two months.
Cadell was OK but the criminal conviction was a defense against major claims
I was preparing against the SA and Com. Governments.

see Rofe has had a stroke; 'so has his team

Geoff, you have to be kidding! Thorpe is caught out fabricating evidence
and committing perjury yet I go to jail and she stays free!
SA
is uncivilised, Zelling J was reported saying this in the Advertiser on
January 16, 1979 under the heading, 'Appeals deserve the fullest check:
judge'
Nothing
has changed since 1979. SA is a disgrace. SA prosecutes when it should
not and does not prosecute when it should.
Why
not see if one of Rofe's team will email me with the purpose of resolving
this Thorpe/Robertson Matter.
I
don't want Thorpe jailed, all I want is my conviction quashed so I can
start off by suing Simon Lane for Malicious Prosecution. Simon is
not sick and it is about time this whole affair became public.

of conversing with several keen legal minds: John Bray, Keith Sangster,
Brian Cox, John Doyle, Bob Fisher, Ian Ward, Lionel Murphy and William
Deane come to mind.
Yes,
I think you are right, Rofe has a keen legal mind; that explains his non-prosecution
of CAC investigator, Barbara Thorpe.
When
I phoned Ward to tell him of the summons served on me he answered without
hesitation that that was the defense to my civil claims that Ward and I
were working on. Later, when I told Ward that I did not have access
to documents that I needed for my defense, Ward crossly told me that I
would lose.
Assuming
Rofe has a legal mind approaching Ward's, he would just as quickly have
seen that his prosecution of Thorpe would lead to my retrial and a finding
of my innocence. That would have cleared the way for me to gain damages
from CAC/Simon Lane for Malicious Prosecution. So Rofe refused to
prosecute Thorpe.

I
challenge 'decent' in your description. Rofe supported his fellow
wrong-acting public servants and let two innocent private enterprise men
be jailed and financially damaged.
South
Australia is tainted by Rofe and all of the public sector people he is
covering up for.
A
fine legal mind is not enough for anyone doing Rofe's job; integrity is
essential. Whatever you saw on TV is nothing compared with the whole
truth. I only have knowledge of my own case, but based on that, nothing
in the SA Legal World would surprise me.
As Zelling J. put it in the Hinton Matter, 'The
doing of justice between the State and the accused person is a matter of
primary importance in any community which considers itself civilised and
I cannot think that any of the excuses that have been suggested justify
the present state of affairs in this State.'
